TopWire Beer Club Membership Terms & Conditions

General Terms
By joining the TopWire Beer Club ("TWBC"), you are entering into an agreement with Lupulo, LLC, and agree to abide by these terms and conditions, as well as all applicable laws regarding the purchase, transport, and consumption of alcohol. We reserve the right to modify membership offerings, benefits, and terms at any time without advance notice. Please let us know if you have any updates to your email address, mailing address, or other contact information so you receive all communications and shipments. 

Please note that TWBC membership involves automatic renewal and recurring billing.  See "Billing" and "Cancellations" Sections below for more information.

Household Membership
Each Household Membership includes up to two individuals residing at the same address. Both individuals must meet all membership eligibility requirements.

Eligibility
Members must be at least 21 years old to join and participate in the TWBC. Valid identification will be required at pickup or delivery. You may only use TWBC membership for personal and non-commercial purposes.

No Guarantee on Specific Beers
Allocations are subject to availability; specific beers or products are not guaranteed. If availability is limited, you agree that we may satisfy our obligations by providing what we consider to be comparable substitutions.

Customization
Members may fully customize their allocations at the time of pickup, with the exception of the February allocation, when inventory is limited and customization options may be restricted. Customers who have chosen shipping are unable to customize their allocations at this time.

Billing
Membership fees are charged quarterly before the allocation. By joining TWBC, you agree to keep a valid and current payment method on file with us, and you authorize us to automatically charge the payment method on file for all applicable fees, taxes, and shipping charges. You will receive two email notifications before billing, allowing you to make any changes needed. If the payment details for your membership change, your card provider may provide us with updated card information. We may use these new details for future orders to prevent potential interruption or delay in your membership benefits. If you would prefer to opt out from this service, please contact your card provider.

Pickup and Allocation
Allocations must be picked up within 60 days of availability and during our regular business hours. You may authorize another individual (21+) to pick up on your behalf with prior notice and valid identification.

‍Allocations not picked up within this window will be shipped to the most current address we have on file for you. We will charge you a shipping fee, and you will be responsible for ensuring an adult (21+) is available at delivery .

‍We are not responsible for delays or issues resulting from incorrect or outdated shipping or contact information.

Shipping Compliance
Shipping is only available to eligible locations in compliance with applicable state and local laws. By joining TWBC and/or authorizing us to ship products to you, you represent that your membership and receipt of products through the TWBC does not violate any applicable laws. Please note that an adult signature (21+) may be required upon delivery, and we are not responsible for any delivery failures resulting from your failure to provide a required signature. We reserve the right to cancel or modify shipments that do not meet legal requirements.

Pricing
Quarterly allocation pricing is subject to change based on factors including product selection, quantity, can size, and production costs. Members will be notified in advance of any material pricing changes.

Cancellations
Memberships begins when you sign up and automatically renews on a quarterly basis (aligned with quarterly allocations) unless you cancel. You may cancel at any time by emailing us at club@topwirebeer.com. To avoid charges for an upcoming allocation, you must cancel at least 48-hours before the billing date; otherwise, you will be billed for that allocation. Fees already charged are non-refundable.

Missed or Lost Shipments; Limitation of Liability
TWBC is not responsible for beer that is lost, stolen, or damaged after delivery (attempted for confirmed). Replacement shipments are not guaranteed but may be offered at TWBC’s discretion. In any event our maximum liability arising out of or related to the TWBC is the lesser of (a) $100 or (b) the amount you paid us in connection with the TWBC in the three months preceding the event giving rise to the claim.

Communication Consent
By joining the TWBC, you agree to receive communications related to your membership, including billing and allocation notifications. We will otherwise process your information consistent with our Privacy Policy, which is available at https://topwire-hop-project.obtainwine.com/privacy.

Things Outside Control
We are not responsible for delays or changes due to events beyond our control, including but not limited to supply disruptions, weather, or regulatory changes.

Right to Refuse or Revoke Membership
Membership in the TWBC is not guaranteed. We reserve the right to refuse or terminate membership in our sole and absolute discretion, including without limitation to ensure we can provide members with access to selected products and due to misuse of benefits or violation of terms.‍‍‍ ‍
